The 2016 ACE Trade User Satisfaction Survey is now available for trade response. U.S. Customs and Border Protection (CBP) strongly encourages all Importers, Exporters, Brokers, Software Developers, Carriers, and other trade community users of the ACE System to take this 5 -10 minute survey as soon as possible. Your input will allow CBP to formally gauge areas where ACE is doing well and where improvement is needed. A large response will ensure that there is greater statistical validity to the results. This survey will close at midnight on September 19th.

CBP: Proposed regs to modernize TSCA importation process

US Customs, in conjunction with EPA, is proposing to amend the regulations regarding the requirement to file a Toxic Substances Control Act (TSCA) certification when importing chemicals into the United States as follows:

  1. Revise/clarify the definitions of “chemical substance”, “chemical substance in bulk form” and  ‘‘chemical substances, mixtures, or articles’’
  2. Provide an electronic option for filing TSCA certifications in ACE
  3. Eliminate the existing paper-based blanket certification process.
  4. Allow importers to provide electronic notice of exportation and abandonment as an alternative to the paper-based written notice process allowed under the existing regulations

The public comment period closes on September 28, 2016

October  1. Vector flat daily calendar icon. Date and time, day, month. Holiday.A major ACE deadline is just weeks away, and the trade, software vendors, CBP and the PGAs are experiencing angst as they get used to the new system and try to anticipate the unknowns of what is to come.

As of October 1, CBP expects to add ACE functionality for all remaining electronic portions for the cargo process:

  • Duty Deferrals
  • Drawback
  • Reconciliation
  • Statements (with associated collections functions)
  • Liquidation

 

In addition, 17 PGAs still need to be brought online, with no hard-and-fast published deadline, though some are pushing to make the October 1st deadline.  This is the subject of much debate on the ACE daily technical calls (open to the public).

Not surprisingly, this is causing shippers great concern (see Journal of Commerce article, “US shippers still grappling with ACE growing pains”)*, especially as CBP is still changing its ACE implementation guide and addressing system glitches from previously launched ACE functionality.

Unfortunately, there is no single, updated repository for the trade to keep current on these issues.  At this point, our recommendation to stay up-to-date with ACE deadlines is to participate in (or listen in on) CBP’s daily ACE technical calls with PGAs.  (1-877-336-1828 call ID 6124214.  1pm CST).

ACE: System bug requires a call to CBP reps to process certain in-bond/FTZ entries

A glitch in ACE requires filers of certain in-bond entries to contact their CBP client representatives to intervene, for the time being, to generate an arrival message.

Per CSMS #16-000731:  For ACE Cargo Release entries moving in-bond from FTZ facilities to bonded warehouses, the bill of lading type “FTZ Withdrawal” doesn’t generate an arrival message which is necessary for ACE Cargo Release processing to occur.  For any entries in this scenario which remain in Admissible status after successful submission and manual release by Ports if applicable, please contact your Client Rep and reference existing ticket # INC000002914731.  The ACE Cargo Release team is working on an update which should be deployed to PROD by 9/9/2016.  An additional CSMS will be sent when the update has been deployed.

Entry release and entry summary filing numbers have begun to converge based on expanded ACE functionality.  Note high percentage of FDA filings relative to total PGA filings.  FDA has done a solid job in outreach to the trade on ACE.

US Customs is hosting a Reconciliation Business Webinar, scheduled for 12:30 p.m. EDT, tomorrow, August 19th. Register here.

As CBP’s reconciliation program will migrate from ACS to ACE on October 1, you need to be ready.  There are important changes coming, including the fact that CBP will no longer be applying blanket flags to entry summaries.  As reported by the Law Offices of George R. Tuttle, III, after October 1, the importer will have to arrange blanket flagging with their broker. Additionally, if the importer is using multiple brokers, the importer will have to contact each one to ensure that they are blanket flagging.

CBP/EPA: Harmonize import entry requirements for different classes of vehicles, engines and allow e-filing of docs

From today’s Federal Register:

In an effort to provide consistency in the administration of CBP’s vehicle and engine imports program so that importers of both road vehicles and engines, as well as stationary and nonroad engines (including engines incorporated into vehicles or equipment), are subject to the same filing and recordkeeping requirements, CBP is proposing to conform the entry filing requirements applicable to the EPA Declaration Form 3520-21 to those that currently exist for EPA Declaration Form 3520-1

CBP proposes to amend existing regulations to permit the electronic filing of EPA Declaration Forms 3520-1 and 3520-21 to CBP in the ACE or to any other CBP-authorized electronic data interchange system. (The EPA declaration forms may also still be filed with CBP in paper with a paper entry filing at the time of entry.)

The electronic transmission to CBP of EPA declaration forms will

  • automate and enhance the interaction between the EPA and CBP by facilitating electronic collection, processing, sharing, and review of requisite trade data and documents during the cargo import and export process.
  • provide for a quicker and more efficient clearance process and enhance CBP’s ability to conduct targeting and enforcement of importation requirements.
  • permit CBP to analyze and flag problems immediately, whereas paper filings result in an ad-hoc process that requires a physical inspection by a CBP or EPA inspector.

Comments on the proposed rule must be received on or before September 16, 2016.
